The following terms and conditions apply to the services provided by Inkjin ("Inkjin," "we," "us," or "our") via the website inkjin.com ("Website") and the mobile application ("Platform").

The Platform is a mobile application that allows users ("User," "you," "your," or "yours") to search for tattoo designs ("Designs") submitted by tattoo artists ("Artist") on the Platform, and virtually preview these designs on their bodies using the Platform's Augmented Reality ("AR") technology.

By using the Website, the Platform, and the services provided, users unconditionally accept the terms of this agreement and agree to comply with them while using these services in accordance with the current Greek legislation. Acceptance of these terms does not mean, under any circumstances, the establishment of any form of employment, collaboration, or partnership with Inkjin.

Inkjin does not guarantee continuous, uninterrupted, or secure access to the Platform under these terms, as its operation may be affected by factors beyond its control.

Inkjin provides a Platform where artists can showcase tattoo designs. By creating a user profile, users can discover designs and artists, use our Augmented Reality technology to try on designs virtually on their body, and directly communicate with artists for tattoo services they offer.

Inkjin reserves the right to change the terms of use without prior notice.

Users of the Platform are required to carefully read the Terms of Use and Privacy Policy before using Inkjin's Platform and services, and in case of disagreement, they should refrain from using the Platform.

Inkjin has not entered into any form of collaboration, employment relationship, or partnership with the artists hosted on the Platform, nor does it resell or act as a third-party representative of the artists in any way.

Inkjin provides the Platform to users and artists free of charge and facilitates users' communication with artists hosted on the Platform. It should not be interpreted as a recommendation or endorsement of the quality, service level, qualifications, or assessment of any artist or the services they offer.

The information and designs provided on our Platform are provided by the artists who bear full responsibility for the accuracy and correctness of this information. When you communicate, make a reservation, or purchase a tattoo service from an artist, you enter into a direct (legally binding) contractual relationship with the respective artist. The Platform has no responsibility and does not guarantee the quality and safety of the tattoo services provided by the artist.

Although we will use reasonable skills and care in providing the Platform, we cannot guarantee that all information is accurate, complete, or correct, nor can we be held liable for any errors (including manifest and typographical errors), any interruptions (whether due to any temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise, inaccurate, misleading or untrue information or non-delivery of information.

To use the Platform, you must create an account and provide certain information about yourself. You can register as a user of the Platform by entering and verifying your email address.

When you create an account with us, you certify that you are at least 18 years old and that the information you provide is accurate, complete, and up-to-date at all times. You may not impersonate another person, establish, claim, or use an account for someone other than yourself, offer an email address that is not your own, or create fake or multiple accounts.

It is noted that the designs displayed on the Platform belong to the artists hosted on the Platform and are used with their permission only on the Platform. Therefore, copying, modifying, paraphrasing, or republishing the designs displayed by the artist on the Platform is prohibited.

Accessing and using the services of the Platform must comply with these Terms of Use. The use of any method of monitoring the Platform or copying part or all of its operation mechanism or content is not allowed.

Inkjin reserves the right to temporarily or permanently prohibit the use of its services to any user of the Platform who, in the absolute discretion of Inkjin, does not comply with these Terms of Use or applicable law. Inkjin may exercise this right if the user uses offensive or insulting language to Inkjin staff or artists hosted on the Platform, or if the user provides false registration information. If the use of the Platform's services is suspended or prohibited for a user, re-registration or use of the Platform's services is not allowed without the prior written consent of Inkjin.

You are solely responsible for all activities related to your user account. If you believe there is a risk of security breach or unauthorized use, please contact us immediately at [email protected].

Any illegal content that may exploit or harm minors in general or violates or supports the violation of Greek or European legislation is prohibited.

Generally, designs by artists depicting nudity or erotic content are allowed without censorship. However, designs depicting behaviors that may lead to violence, such as non-consensual or violent sexual acts, including rape, are not allowed. Designs depicting fetish content involving acts that may lead to the death of humans or animals, dismemberment, cannibalism, or bestiality are also not allowed.

Inkjin does not allow designs containing defamatory comments promoting religious, sexist, homophobic, or racist hatred or engaging in other forms of discrimination and will be immediately removed. Inkjin reserves the right to restrict users who create, upload, or request designs of this nature.

You acknowledge and agree that we may monitor and delete content, in whole or in part, that we believe violates the rules or may harm the Platform's reputation. Of course, we can't monitor all content or designs, every user review or comment that appears, and so on. As a result, we operate on the "notice and action" principle, which means if we receive information about offensive content, we will investigate and take appropriate action.

Unless explicitly stated, all designs displayed on the Platform, which can be used to virtually display designs on your body using the Platform's Augmented Reality technology, are the intellectual property of each artist hosted on the Platform and are protected by relevant provisions of Greek law, European law, and international conventions. As a result, none of them can be sold, copied, modified, reproduced, republicated, "loaded," communicated, or disseminated in any form.

The intellectual property rights of the Platform belong to Inkjin. Unless explicitly stated, Inkjin owns the software required and used by the Platform, as well as the intellectual property rights related to the Platform's appearance and feel, including its infrastructure and visitor reviews. You are not allowed to reproduce all, in part, a summary or a paraphrased adaptation of the Platform's content using any electronic, mechanical, or photocopying means is prohibited without prior written permission.

An exception is made in the case of content generated using Augmented Reality technology, i.e., photos displaying a design on a specific part of your body, for personal and not commercial use and without removing their indication of origin from Inkjin, without in any way affecting the relevant intellectual property and industrial property rights.

Upon receipt of a complaint that certain content is inappropriate, infringes on the rights of any third party, or if Inkjin decides to remove content for any reason, it reserves the right to remove it immediately or within a timeframe that it decides, at its discretion. All such actions are taken without any admission as to liability and without prejudice to any rights, remedies, or defenses, all of which are expressly reserved.

When Inkjin receives a complaint, it reserves the right to verify your identity and seek additional information to verify your claims. During the notice and removal of content procedure, we may take certain actions, such as removing content and making an effort to prevent future violations. This includes forwarding the complaint to the involved parties that provide the content infringing on any third-party rights.

You agree that you bear sole responsibility for the consequences arising from your complaints (including, but not limited to, the removal or blocking of the submitted content) and acknowledge and accept that all complaints may be used in legal proceedings. Any false, misleading, or inaccurate information from you may incur civil and criminal liabilities.

Inkjin is not responsible for, and has no control over, the availability, content, privacy policies, quality, or completeness of services provided by other websites and web pages to which it links. As a result, if you have any problems during your visit/use, you should contact the specific websites and pages that are responsible for providing their services. Inkjin should in no way be considered as endorsing or accepting the content or services of the websites and pages to which it refers or as being associated with them in any other way.

Your permission to use the Platform is conditioned upon the following Restrictions:

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

Under any circumstances, including negligence, Inkjin is not liable for any damage suffered by the user of the Platform, choices, and content of Inkjin in which the user engages on their initiative and with knowledge of the terms herein.

Inkjin does not assume responsibility and does not guarantee the quality of the tattooing services provided by the artists in their respective spaces to the users of the Platform and bears no responsibility in the event of any dispute or issue arising between the artist and the user.

Inkjin does not guarantee the accuracy, completeness, or availability of the Platform, its content, pages, services, options, or their results in any case.

Inkjin provides the Platform and makes every reasonable effort for its continuous and proper operation and maintenance. The user agrees that Inkjin shall not be liable for any interruption or non-smooth operation of the Platform. In the event of malfunction or temporary non-operation of the Platform, Inkjin will make every effort to restore the operation of the Platform, and shall not be liable for the period until the proper operation of the Platform is restored.

Subject to the limitations set out in these Terms and to the extent permitted by law, the Platform is provided on an “as is” and “as available” basis; and to the extent permitted by applicable law, grants no warranties of any kind, whether express, implied, statutory or otherwise with respect to the Platform (including but not limited to all services and content), including, without limitation, any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement.

The Terms and the provision of our Platform shall be governed by and construed in accordance with Greek law, European Union law, and applicable international agreements.

If any provision of these Terms is or becomes invalid, unenforceable, or non-binding, you shall remain bound by all other provisions hereof. In such an event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable, or non-binding provision, given the contents and purpose of these Terms.

This constitutes the entire agreement between Inkjin and the user of the Platform and binds only them.
