These terms apply to every tattoo artist and studio that uses Inkjin, Bookpay or Omi. Parts A, D and E apply to everyone. Part B applies if you use the Inkjin app or Bookpay. Part C applies if you use Omi.
Part A. General
A1. Who we are and who these terms are for
The company "INKJIN PRIVATE COMPANY" (Inkjin IKE), headquartered at 332 Kifisias Avenue, 15233 Chalandri, Attica, Greece, Tax ID 803292939, Tax Office KEFODE Attikis, General Commercial Registry No. 193959701000 ("Inkjin", "the Company", "we"), operates:
the website inkjin.com and the mobile application Inkjin ("the Application"), where clients ("Users" or "Clients") find tattoo designs, preview them with Augmented Reality, and book and pay tattoo artists;
Bookpay (bookpay.inkjin.com), where artists manage their profile, bookings, payments and consent forms;
Omi (omi.inkjin.com), an AI tattoo assistant that helps clients plan a tattoo and find artists, and that can answer an artist's Instagram direct messages on their behalf.
Together, these are "the Services". These terms apply to tattoo artists and studios ("Artist", "you") who create or claim a profile, or use any of the Services to offer tattoo services. They apply together with Inkjin's Terms of Use and Privacy Policy, which form part of them.
By creating or claiming a profile, or by using any of the Services as an Artist, you accept these terms. If you don't agree with them, don't use the Services as an Artist.
A2. Our relationship
Using the Services doesn't create an employment relationship, partnership or any other form of dependency between you and Inkjin. You act as an independent professional, fully and solely responsible for the tattoo services you provide, for setting your prices and for complying with the law.
The Services host your professional profile, help clients find you and contact you, and help you manage requests and bookings. Inkjin doesn't take part in, guarantee or take responsibility for the tattoo services you provide.
A3. Accurate information
You must give accurate, true, up-to-date and complete information about yourself, your work, your studio and your prices, and update it promptly when it changes. You're solely responsible for any damage caused by false, inaccurate or misleading information. We may ask you to verify information, and may suspend or deactivate your profile if we have doubts about it.
A4. Professional conduct
You must behave professionally when using the Services and when providing tattoo services. Abusive, indecent, harassing, aggressive or misleading content or behavior toward Clients, Inkjin or through the Services is prohibited. You must follow the codes of ethics of the tattoo profession and respect Clients' rights and dignity.
A5. Your content and intellectual property
Any photo, video, design, description or other material you make available through the Services ("Content") must be your own original work, or you must hold a valid license to use it. Your Content must not infringe intellectual property, trademarks, image rights, personal data or any other right of a third party. You're fully liable for any such infringement, and you will indemnify Inkjin against any damage, claim, cost or expense (including legal costs) it causes. If someone claims your Content infringes their rights, tell us promptly and cooperate in resolving it.
By making Content available, you give Inkjin a non-exclusive, revocable license to use it to show your profile, promote your services through the Services, and in communication and promotion of the Services. We acquire no other rights over your work. You may ask us to remove your Content at any time, except material we have already lawfully used.
Designs showing nudity or erotic content are allowed. The following are not, and will be removed immediately:
designs showing behavior that could lead to violence, such as non-consensual or violent sexual acts, or other violations of sexual freedom that may be a criminal offense;
fetish content involving acts likely to cause the death of a person or animal, dismemberment, cannibalism or bestiality;
defamatory content, or content that promotes religious, sexist, homophobic or racist hatred or other discrimination.
Content that is offensive, defamatory, unlawful, misleading, dangerous or against the health and safety rules of tattooing is not allowed. We may remove any Content that we consider breaks these terms, third-party rights or the law.
A6. Lawful use
You must use the Services only for lawful purposes, and must not do anything that could damage how they work, hinder other people's use of them, or endanger the security of their systems or data. Unauthorized access, alteration or reproduction of the Services is prohibited, and you're liable for any damage caused by misuse.
Part B. Inkjin app and Bookpay
This part applies if you use the Inkjin app or Bookpay to show your designs, take bookings or receive payments.
B1. Registration
To register, you must have at least 2 years of professional experience providing tattoo services, work at a recognized and lawfully operating tattoo studio, have a portfolio of original work in the styles you specialize in, and comply with the health, insurance and tax laws where you work. If you meet these criteria, you can apply at bookpay.inkjin.com/register.
When you register, you give us:
Required: full name; mobile phone number; email address; how your name should appear on your profile; your main style and up to 2 secondary styles; years of experience; your studio and how you work there (self-employed, associate, employee, etc.); the city or area you work in; professional bank account details (account number, IBAN, account holder name, BIC/SWIFT) at a lawfully operating credit institution; and your acceptance of these terms.
Optional: a link to your social media or website, and a pseudonym your clients know you by.
We review your information, approve your registration and contact you to complete your profile. Your inclusion requires that you accept these terms and have been informed of the Privacy Policy.
B2. Payments
Deposit or full payment. When a Client confirms an appointment after agreeing the design, cost and other details with you through Inkjin, they pay through the Application in a secure environment run by an external payment services provider. The Client may pay only a deposit and pay you the balance on the day of the appointment.
Booking fee. A booking service fee of ten euros (€10) in favor of Inkjin is added to each booking and collected from the Client with their payment. This fee relates only to the Client's relationship with Inkjin, and you're not entitled to any share of it. Inkjin charges you no monthly fee and takes no commission on your payments, and doesn’t charge the Client anything beyond this fee.
Payment provider. Payments are processed by Stripe, or by another lawfully operating payment services provider we may choose in the future. The payment provider’s standard processing fees on the payments you receive are paid by you and deducted from those payments. They depend on the payment method: bank payments such as SEPA or iDEAL usually cost less than card payments. We may change provider at any time and will tell you through the Services or these terms. Using these features requires you to accept the provider’s terms of service.
Payment information. Through your profile you can see whether a Client's payment succeeded, its amount, the payment method and the booking fee charged. You're responsible for checking this information.
Our liability. Inkjin's responsibility is limited to securely redirecting the Client to the payment provider's environment. We're not liable for payments made through the provider, delayed or incomplete payments by Clients, or financial disputes between you and a Client.
B3. Health and safety
You must comply with all health, professional, insurance and regulatory requirements where you work. For example, you must:
meet the health and safety standards set by local, national or regional law for tattoo services;
keep a clean, sterile and safe working environment, using approved single-use equipment and materials or properly sterilized tools;
apply infection-prevention procedures, including proper handling and disposal of medical and sharps waste;
hold any licenses, approvals, certifications or qualifications required where you work;
follow required client information and consent protocols, including informing Clients of risks and contraindications;
protect the health and safety of Clients and any staff you employ.
You're solely liable for any consequence of not meeting these requirements, and Inkjin is not liable for your omissions or violations. We may ask you at any time for documents showing you meet them, and may suspend or deactivate your profile if you don't.
B4. Cancellations, appointments and availability
You must publish a cancellation policy stating the cancellation deadline (for example 24, 48 or 72 hours before the appointment), any cancellation fees, and the terms for rescheduling, including any limit (for example once, twice, unlimited or not at all). You must show your availability accurately, and you're solely responsible for keeping appointments, managing your calendar and avoiding double bookings or unjustified cancellations. Inkjin is not liable for your cancellation policy, your scheduling errors or their consequences.
B5. Consent forms
Where the Services let you create, customize and send client consent and health screening forms ("Consent Forms"):
you alone write their content, including risk disclosures, health questions, aftercare instructions and any age-verification or guardian-consent provisions, and you judge what is legally sufficient where you work;
Inkjin provides the technical means to create, deliver, capture and store Consent Forms, but doesn't draft, review, verify or endorse their legal sufficiency;
you're solely responsible for making sure your Consent Forms, and your practices on age verification and tattooing minors, comply with the law where you work;
Inkjin is not liable for any Consent Form's content, for your reliance on any default or template wording, or for a Consent Form being found legally insufficient;
a signature captured through the Services is a "simple electronic signature" under Regulation (EU) No 910/2014 (eIDAS), and you agree it's sufficient for your Consent Forms. Outside the EU, any additional signature requirements of your local law still apply.
B6. Available designs and custom tattoos
You may offer designs as "Available Designs" or accept Client requests for custom designs ("Custom Tattoos"). Creating, changing, managing, delivering and pricing them is your sole responsibility; Inkjin doesn't take part in designing, negotiating, approving or completing the work, or review its content, quality or artistic value. You're responsible for the accuracy of what you post, for keeping to what you agreed with the Client, and for any dispute that arises. We may set and change rules on how designs are shown, categorized and made available, and may remove, hide or restrict designs that break these terms, third-party rights or our specifications.
Part C. Omi
This part applies if you claim a profile on Omi or use any of Omi's features for artists.
C1. Claiming your profile
Omi may already show a profile for you, built from public information. You may only claim a profile that is yours, or your studio's if you're authorized to act for the studio. We review claims before approving them, and may refuse, pause or remove a profile that is inaccurate, misleading or breaks these terms. You can unclaim your profile at any time in Omi.
C2. Training Omi
Omi answers clients only from the information you give it in Train Omi: your prices, rules, styles, studios, availability, how it should write, and the corrections you make. You're responsible for keeping this information accurate and up to date.
Omi is an artificial intelligence system and may occasionally give inaccurate or incomplete answers. Prices Omi gives are a guide only; you give the final quote. Omi never confirms bookings, takes payments, gives medical advice or recommends other artists on your behalf.
C3. Omi in your Instagram direct messages
When you connect your Instagram professional account to Omi and switch on "Let Omi reply to your DMs":
Your instruction. You instruct Inkjin to read the direct messages sent to that account, answer them on your behalf through Omi, and pass tattoo requests to you.
Omi says it's an AI. Its first reply in a conversation always says it's an AI assistant.
Omi steps back when you write. As soon as you write in a conversation, Omi stops replying there. It doesn't reply to people you were already chatting with before you switched it on.
Instagram's rules. You must use Omi in line with Instagram's and Meta's terms and policies. Instagram only allows automatic replies within 24 hours of a person's last message; requests Omi couldn't answer in time are shown to you so you can reply yourself.
You're in control. You can switch replies off or disconnect Instagram at any time in Omi, or remove Inkjin in your Instagram settings.
C4. Client requests
Requests Omi collects, in Omi's chat or in your Instagram direct messages, appear in your Leads in Omi and are emailed to you. You reply to the Client directly. Any agreement about the tattoo, its price and the appointment is between you and the Client; Inkjin is not a party to it.
C5. Instagram posts
When you connect Instagram, Omi copies your latest posts and profile photo to show them on your Omi profile, and keeps them up to date weekly. Disconnecting Instagram stops the updates; the posts already copied stay on your profile until you remove them or unclaim your profile.
Part D. Your clients' personal data (data processing agreement)
This part is an integral part of these terms and is a data processing agreement between you and Inkjin under Article 28 of Regulation (EU) 2016/679 ("GDPR").
D1. Roles
For your Clients' personal data, you are the Data Controller (Article 4(7) GDPR): you decide why and how it's processed. Inkjin is the Data Processor (Article 4(8) GDPR): it processes that data on your behalf and on your instructions, as set out in these terms and through your use of the Services.
D2. What is processed, and why
Service | What Inkjin does for you | Clients' data processed |
Inkjin app and Bookpay | Manages appointments; confirms, changes and cancels bookings; carries messages between you and Clients; collects Consent Forms | Identification and contact details, booking and appointment details, the selected design, payment status, Consent Form answers and signatures |
Omi | Reads and answers messages sent to your connected Instagram account; collects requests and passes them to you | Instagram username and name, the content of messages and pictures sent, the request details (idea, placement, size, color, timing, budget) |
The data subjects are Clients who book with you or send you a request, and people who message your connected Instagram account.
D3. Duration and deletion
Processing lasts for as long as you use the Services and as needed to meet the parties' contractual and legal obligations. In addition, for Omi:
a conversation from your Instagram direct messages, its pictures and its request are deleted 6 months after its last message;
when you disconnect Instagram, or remove Inkjin in your Instagram settings, the messages and pictures are deleted immediately, and requests stay in your Leads for 30 days, then are deleted;
everything is deleted at once when you ask us to.
When you stop using the Services, Inkjin will, at your choice and unless the law requires otherwise, delete or return the personal data it processes for you and delete any copies.
D4. Your responsibilities
You're fully and solely responsible for the lawfulness of collecting and processing your Clients' personal data, for having a valid legal basis, for informing your Clients, and for complying with the principles of Article 5 GDPR. Where you collect additional data, including special categories such as health data, you do so solely as Data Controller and are fully responsible for complying with the law. Inkjin is not liable for GDPR violations caused by your acts or omissions as Data Controller.
D5. Our commitments
Inkjin will:
process the data only on your instructions as set out in these terms, and not use it for other purposes. If Inkjin uses Clients' data for a purpose of its own not covered by these terms, it does so as an independent controller for that purpose;
not use your Clients' data to train artificial intelligence models;
make sure the people authorized to process the data are bound by confidentiality;
apply appropriate technical and organizational measures to protect the data against unauthorized or unlawful processing, loss, destruction or damage;
help you, as far as possible, to answer requests from Clients exercising their rights, and to meet your obligations on security, breach notification and, where required, impact assessments;
notify you without undue delay of a personal data breach affecting data it processes for you, with the information you need to meet your obligations.
D6. Sub-processors
You give Inkjin general authorization to use sub-processors, as long as they give sufficient guarantees of GDPR compliance and are bound by obligations equivalent to this agreement. Inkjin currently uses:
Sub-processor | What for |
Stripe | Payments (Bookpay) |
Anthropic | Writing Omi's replies (artificial intelligence); doesn't use the data to train its models |
Netlify | Hosting the Services |
Cloudflare | Storing pictures and files |
Postmark | Sending emails |
Meta | Instagram messaging, for artists who connect Instagram to Omi |
D7. Transfers outside the EEA
Some sub-processors are located outside the European Economic Area, for example in the United States. Where personal data is transferred outside the EEA, it's protected by an adequacy decision of the European Commission (such as the EU–US Data Privacy Framework) or by the European Commission's Standard Contractual Clauses.
D8. Inkjin as an independent controller
Inkjin is an independent Data Controller only for data it processes for its own purposes: Users' registration and use of the Services, browsing designs, Augmented Reality, the contract with you, tax and accounting, and the security of the Services, as described in the Privacy Policy. For your own personal data as an Artist, see the Privacy Policy.
Part E. Liability, changes and law
E1. Inkjin's liability
Inkjin makes every effort to provide accurate, complete, reliable and up-to-date information and Services. Given the nature of the internet and of our products, you accept that we can't control all content and the security of the Services at every moment, or guarantee that they are free of viruses or harmful files. Protecting your own equipment and software is your responsibility. We will promptly try to correct inaccuracies, errors and technical faults, whoever reports them.
You use the Services and their content at your own risk. We may suspend all or part of the Services for maintenance, upgrades or any other reason we consider appropriate, and we don't guarantee their accuracy, completeness or availability. If the Services stop working or don't work properly, we will try to restore them, and we're not liable for the time until they do.
Inkjin doesn't decide, and isn't liable for, the methods you use, your acts or omissions in practicing your profession, the quality of your work, your prices, or any dispute between you and a Client, including financial transactions outside the Services. Listing you on the Services isn't an endorsement of your work, qualifications or rating. You must make sure appointments take place somewhere you're lawfully entitled to receive Clients, with all legal requirements met.
For Omi, Inkjin isn't liable for what you set in Train Omi, for decisions Clients make based on Omi's answers, or for messages Omi doesn't answer, for example outside Instagram's 24-hour window or during an Instagram outage.
To the extent the law allows, Inkjin is not liable for any direct, indirect, moral, consequential or other damage arising from or connected with the use of the Services. Nothing in these terms limits liability that the law doesn't allow to be limited.
E2. Links to other websites
The Services may link to third-party websites that Inkjin doesn't control. We're not liable for their content, links or changes, and a link doesn't mean we endorse them. Using them is at your own risk and subject to their own terms.
E3. Inkjin's intellectual property
All content of the Services (names, marks, images, graphics, photos, designs, text), the software, and the rights in their appearance, functionality, infrastructure and ratings belong to Inkjin or to third parties who have licensed them to us, and are protected by Greek, EU and international law. Copying, transferring, creating derivative works from, reproducing, republishing, distributing or otherwise using them, for commercial or other purposes, requires our prior written consent or that of the rightsholder. Misleading the public about who runs the Services is prohibited.
E4. Suspension and deletion
We may suspend or delete your profile or account if you break these terms, Greek law, or the law of any country where you work, for example by giving false or misleading information, misusing the Services, infringing intellectual property, or not following health and safety rules. You can stop using the Services at any time: in Omi, by switching off DM replies, disconnecting Instagram or unclaiming your profile.
E5. Changes to these terms
We may change these terms and will tell you about changes through the Services and on this page, which shows the date of the last update. Please check it from time to time. If a change affects Part C or Part D, Omi asks you to agree again before it keeps answering your Instagram direct messages.
We oversee how these terms are applied. If you break them, you will compensate Inkjin for any direct and consequential damage it suffers as a result.
E6. Governing law
These terms, and any change to them, are governed by Greek law and European Union law. If any part becomes contrary to the law, it stops applying and is removed, without affecting the rest. Any dispute between you and Inkjin about these terms is governed by Greek law, and the competent courts of Athens have exclusive jurisdiction.
E7. Contact
Questions about these terms: [email protected]. Questions about personal data: [email protected].
